SetSage Trainer Terms
Summary
- These terms apply on top of the SetSage Terms of Use when you coach clients in SetSage.
- Your clients choose what you see. Use it only to coach them, keep it confidential, and delete your own copies when you stop coaching them.
- You're responsible for your advice, your qualifications and insurance, for checking a client is fit to train, and for following the law where you coach.
- You must not coach anyone under 18 in SetSage.
- Messages must be about training and respectful. Clients (and you) can report and block. We review reports and may end accounts.
- Coaching up to 3 clients is free. Trainer and Trainer Plus cover 30 and 100, and your linked clients get Pro.
1. Who these terms are between
These terms are between you, as a trainer using SetSage to coach clients, and Check Zanas Ltd ("we"), registered in Scotland (SC874025), 41 Craigie Loanings, Aberdeen AB25 2PS. They add to the SetSage Terms of Use and the Acceptable Use and Complaints Policy. If these terms and the Terms of Use disagree about coaching, these terms apply.
You accept them when you tick the box to agree to them while setting up your trainer profile in the app. If you set up your profile before that box existed, you accept them the next time you use trainer features after we show them to you.
2. Your relationship with your clients
- Your clients are your clients, not ours. You are not our employee, agent or partner, and we don't check your qualifications.
- You agree your fees, sessions, cancellations and payment with each client directly. SetSage doesn't take payments for your sessions. You are responsible for giving your clients the information consumer law requires for your services.
- SetSage is available in many countries, and you and your clients may be in different ones. You are responsible for following the laws that apply to your coaching where you and your clients are, including any rules on qualifications, licensing, insurance, consumer rights, tax and data protection.
- You confirm that you hold the qualifications and insurance your coaching needs (for example, professional indemnity and public liability cover), and you are responsible for your advice.
- No under-18s. You must not invite, link with or coach anyone under 18 through SetSage, in any country, even where local law treats younger people as adults for some purposes. If you learn a client is under 18, end the link and tell us at hello.setsage@gmail.com (or report them with "They seem to be under 18"), so we can close their account as the Terms of Use require.
- Before you programme for a client, check they are fit to train, for example with a health questionnaire, and take account of what they tell you.
3. Client data
How the roles work. Each client decides what you can see. We are the controller of the data we hold to run SetSage. You are a separate controller of the client data you use to coach, and of any notes or records you keep outside SetSage.
When a client links with you, they choose what you can see: plans, schedule and goals are always shared; workouts, heart rate, body details, sleep and recovery, and their training diary only if they switch them on. They can change or withdraw this at any time, and when they do, the data behind that switch is removed from your view. You must:
- use a client's data only to coach that client;
- keep it confidential and not share it with anyone else without the client's permission, unless the law requires it;
- not copy it out of SetSage except as you need to coach them, and delete those copies when you stop coaching them;
- tell clients about any notes or records you keep outside SetSage, as data protection law requires;
- tell us at hello.setsage@gmail.com without delay if you think a client's data has been seen by someone who shouldn't have it.
Health information (heart rate, body details, sleep and recovery, injuries, diary notes and anything a client tells you in messages) is special-category data. Handle it with particular care.
Data protection law applies to what you do with client data outside SetSage: the UK GDPR if you are in the UK, the EU GDPR if you are in the EU or EEA or coach clients there, and your own country's privacy law elsewhere. If you are in a different country from your client, what they share reaches you there.
Templates. You can save the structure of a client's plan (exercises, sets and percentages) to your own templates and copy it to another client. Their weights and training maxes don't go with it. Don't save anything in a template that identifies the client.
Training maxes and programmes. Programmes, goals and training maxes you send are suggestions. Nothing changes until the client approves it, and no training max or weight target can rise more than 10% in one change.
4. Messages and conduct
Messages in SetSage are for training. You must not use them to:
- harass, threaten, bully or demean anyone, or send hateful content;
- send sexual content, or pursue a personal relationship with a client through SetSage;
- ask for money, bank or card details, passwords or codes through messages (arrange payments through your usual business channels);
- promote unsafe training, extreme dieting, or products or services unrelated to coaching;
- share a client's messages or data with anyone else.
Clients can report a message or you, and block you, from the conversation's ⋮ menu or by pressing and holding a message. So can you. This works for up to 30 days after a link ends. When someone blocks you, your link ends, you stop seeing what they shared, and you can't invite them again unless they unblock you. We keep a copy of reported messages to review them. We don't tell the other person who reported them.
5. Reports and what we may do
We aim to review reports within 2 working days, and sooner where someone may be at risk. We act as the Terms of Use, section 7B (Online safety), explain. Depending on what we find, we may warn you, remove your ability to message, end links, suspend or close your trainer account, or close your SetSage account. Where we can, we'll tell you why and give you a chance to respond, unless that would put someone at risk or the law stops us. You can ask us to look again (see the complaints section of the Acceptable Use and Complaints Policy). When we act against your content or account, we tell you what we did, the facts we relied on, which rule or law was broken, and how you can challenge it, unless the law or a risk to others stops us. If we believe someone is in danger, or a crime has been committed, we may contact the police or another authority. If someone is in immediate danger, call your local emergency number.
6. Trainer plans
Coaching up to 3 clients is free. Trainer (£19.99 a month or £199.99 a year in the UK, up to 30 clients) and Trainer Plus (£39.99 a month or £399.99 a year in the UK, up to 100 clients) are Google Play subscriptions. Outside the UK, Google Play shows the price in your local currency, including any tax it charges. New subscribers get 30 days free. They are cancelled, refunded and priced as the Terms of Use and the Subscriptions and refunds page say, and include Pro for you.
If you have more clients than your plan covers, the most recently joined over the limit are paused: you can still see what they share, but neither of you can send new messages or programmes until you have room. While a client is linked to you on a paid plan (and not paused), they get SetSage Pro at no cost to them, with the free SetSage AI allowance. It ends when they leave or your plan ends.
7. Ending
You can stop coaching a client, or stop being a trainer, at any time in the app. Your clients can leave at any time. When a link ends, what the client shared under it is deleted from SetSage. We keep a copy of your names, the last 50 messages and the last 5 programmes or training maxes you sent, which only we can see, for 30 days so either of you can still report a problem; then it is deleted. A message or programme our sending limits held back (too many sent at once) is never shown to the client and is deleted after 7 days. Sections 3 (your copies) and 5 (reports) continue after a link or these terms end.
8. Liability
Our liability to you is as set out in the Terms of Use, section 14. You are responsible for your coaching advice and for how you use client data outside SetSage.
9. Law
These terms are governed by Scots law, as the Terms of Use say. Where you coach as a business, the Scottish courts decide any dispute about these terms, unless the law where you live says otherwise. If you use SetSage for your own training as a consumer, section 17 of the Terms of Use applies instead.
10. Changes and contact
We may update these terms and will tell you in the app at least 30 days before a change that affects you badly takes effect. Questions: hello.setsage@gmail.com.
